Terms of Service

1. Acceptance of Terms

By accessing or using Bhotforge AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Bhotforge AI.

2. Description of Service

Bhotforge AI provides a platform for creating, training, and deploying AI-powered chatbots using your own documents and knowledge bases. The Service includes document processing, vector database creation, AI model integration, and chatbot deployment capabilities.

3. User Accounts

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Data Processing & Document Handling

When you upload documents to Bhotforge AI, you grant us a limited license to process, chunk, embed, and store these documents solely for the purpose of powering your chatbot's knowledge base. We do not use your documents to train our own models or share them with third parties.

Document Security: All uploaded documents are encrypted at rest and in transit. Documents are stored securely using enterprise-grade encryption and are isolated per user account. You retain full ownership of all uploaded content.

Vector Embeddings: When documents are processed into vector embeddings, the original document content is chunked and converted into numerical representations. These embeddings are stored in your dedicated vector database space and are not shared across accounts.

5. Data Protection & GDPR Compliance

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. As a data processor, we:

• Process personal data only on your documented instructions
• Ensure that persons authorized to process personal data have committed themselves to confidentiality
• Implement appropriate technical and organizational measures to ensure security of processing
• Assist you in responding to requests from data subjects exercising their rights
• Delete or return all personal data upon termination of services, at your choice
• Make available all information necessary to demonstrate compliance with data protection obligations

6. Third-Party AI Providers

Bhotforge AI integrates with third-party AI providers including OpenAI, Anthropic (Claude), and Google (Gemini). When you use these services through our platform:

• Your chatbot conversations may be processed by the selected AI provider
• Each provider has their own terms of service and privacy policies
• If you provide your own API keys, usage is billed directly by the provider
• We do not store conversation data beyond what is necessary for the Service

7. Subscription Plans & Billing

Bhotforge AI offers Free, Pro, and Enterprise subscription plans. Plan features and limits are as described on our pricing page. We reserve the right to modify pricing with 30 days' notice. Refunds are available within 14 days of initial subscription purchase.

8. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, or violates intellectual property rights
• Create chatbots that spread misinformation, hate speech, or harmful content
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Exceed your plan's usage limits through automated or fraudulent means
• Use the Service for any purpose that violates applicable laws or regulations

9. Intellectual Property

You retain all rights to your uploaded content and the chatbots you create. Bhotforge AI retains all rights to the platform, technology, and services. Neither party acquires any rights to the other's intellectual property except as expressly set forth in these Terms.

10. POPIA Compliance (South Africa)

In accordance with the Protection of Personal Information Act (POPIA) of South Africa, Bhotforge AI:

• Acts as the responsible party for the processing of your personal information within the Service
• Processes personal information only for the specific purposes outlined in these Terms and with your consent
• Implements appropriate technical and organizational measures to protect your personal information
• Ensures that any cross-border transfer of personal information complies with POPIA requirements
• Respects your right to access, correct, or delete your personal information at any time
• Notifies the Information Regulator and affected data subjects in the event of a data breach as required by law

11. AI-Specific Terms

By using Bhotforge AI's chatbot creation and deployment features, you acknowledge and agree:

• No Training Without Consent: Your documents, conversations, and chatbot data are never used to train Bhotforge AI's own models or any third-party models without your explicit written consent
• AI Limitations: AI-generated responses may contain inaccuracies. You are responsible for reviewing and validating chatbot responses, especially in regulated industries
• Third-Party AI Processing: When using OpenAI, Anthropic, or Google AI providers, your data is processed according to each provider's respective terms. Bhotforge AI is not responsible for how third-party providers handle data beyond our control
• Embedding Isolation: Vector embeddings derived from your documents are stored in isolated database spaces with row-level security and are not shared with other users
• Feedback Data: If you provide feedback on AI responses (ratings, corrections), this data is stored for your chatbot's improvement and is not shared across accounts

12. Data Processing Agreement

When you use Bhotforge AI to process personal data of your end users (via chatbot interactions), you act as the data controller and Bhotforge AI acts as the data processor. We commit to:

• Process personal data only in accordance with your documented instructions
• Ensure that all personnel with access to personal data are bound by confidentiality obligations
• Implement appropriate technical and organizational security measures
• Not engage sub-processors without your prior written authorization
• Assist you in fulfilling data subject rights requests (access, rectification, erasure, portability)
• Delete or return all personal data upon termination of the Service, at your choice
• Provide all information necessary to demonstrate compliance with applicable data protection laws

13. Data Retention & Deletion

You may delete your documents, chatbots, and account data at any time. Upon account deletion, we will remove all your data within 30 days. Backup copies may persist in encrypted form for up to 90 days for disaster recovery purposes before being permanently deleted.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTFORGE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
